1 Scope
These Terms and Conditions (“Terms”) apply to all contracts concluded through The CEO Bestie between

and you as a customer (“you”).
By purchasing a product or, where applicable, creating a user account, you agree to these Terms in the version applicable at the time of your purchase.
2 Products and Services
The CEO Bestie offers digital products and content, including but not limited to downloadable guides, templates, videos, courses and other digital media.
Depending on the product, content may be provided as a direct download or made available through a password-protected user account.
The specific scope, features and content of each product are described on the respective product page at the time of purchase.
We may update, expand or modify our general product offering at any time. This does not affect your statutory rights or your right to access digital content already purchased to the extent agreed at the time of purchase.
3 User Accounts
Certain products or services may require you to create a user account.
You agree to provide accurate and complete information when creating your account and to keep your login credentials confidential.
User accounts and login credentials are personal and may not be transferred or shared with third parties.
We reserve the right to suspend or terminate user accounts in the event of misuse, unauthorized sharing of content or material violations of these Terms. Your statutory rights remain unaffected.
4 Conclusion of Contract and Prices
The presentation of products on our website does not constitute a legally binding offer but an invitation to place an order.
By completing the checkout process and submitting your order, you make a binding offer to purchase the selected product.
The contract is concluded when we accept your order, for example by sending an order confirmation or by providing access to the purchased digital product.
Unless stated otherwise, all prices are displayed in euros and include applicable statutory VAT.
5 Payments
Payments are processed through Podia and the payment providers available through the checkout process, such as Stripe or PayPal.
The terms and conditions of the respective payment provider may additionally apply to the payment transaction.
Available payment methods are displayed during checkout.
You will receive confirmation of your purchase and, where applicable, an invoice electronically.
6 Right of withdrawl of digital content
Consumers generally have a statutory right of withdrawal in accordance with applicable law.
For digital content that is not supplied on a tangible medium, such as downloadable files, templates, videos or online content, your right of withdrawal may expire once we begin providing the digital content if:
you have expressly consented to us beginning performance of the contract before the expiry of the statutory withdrawal period;
you have acknowledged that, by giving this consent, you will lose your right of withdrawal once performance has begun; and
we have provided you with the legally required confirmation of the contract.
Where required, we will obtain your express consent and acknowledgement during the checkout process before providing immediate access to the digital content.

7 Rights of Use of Intellectual Property
Unless expressly stated otherwise, all digital products, materials and content provided by The CEO Bestie are protected by copyright and other intellectual property rights.
Upon purchase, you receive a limited, non-exclusive, non-transferable right to use the purchased content for your personal use.
You may not, unless expressly permitted:
reproduce or distribute the content to third parties;
share your account or access credentials with third parties;
resell, sublicense or commercially distribute the content;
publish or make the content publicly accessible;
modify the content for the purpose of resale or redistribution; or
remove copyright, trademark or other proprietary notices.
Downloads are permitted where the respective product is explicitly provided as downloadable content.
Any commercial use beyond the intended personal use requires our prior written permission.
8 Availability and Provision of Digital Products
Digital products will be provided in the manner described on the respective product page.
We aim to ensure reliable access to account-based digital content. Temporary interruptions may occur due to maintenance, technical issues, updates or circumstances beyond our reasonable control.
Such temporary interruptions do not affect your statutory rights regarding the proper provision and conformity of digital products.
9 Statutory Rights and Liability
Your statutory rights regarding defective or non-conforming digital products remain unaffected.
We are liable without limitation for damages caused intentionally or through gross negligence, as well as in cases of injury to life, body or health and in other cases where liability cannot legally be excluded or limited.
In cases of slight negligence, we are liable for breaches of essential contractual obligations only. In such cases, liability is limited to damages that were typical and reasonably foreseeable at the time the contract was concluded.
Any further limitation of liability applies only to the extent permitted by applicable law.
10 No Guarantee of Specific Results
Our products and content are intended to provide information, practical tools, perspectives and educational material relating to careers, leadership and professional development.
We do not guarantee any specific professional, financial, career or business outcome resulting from the use of our products or content.
Our content does not constitute individual legal, tax, financial or other regulated professional advice.

12 Goverining Law and Final Provisions
The laws of the Federal Republic of Germany apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
If you are a consumer and have your habitual residence in another country, this choice of law does not deprive you of any mandatory consumer protection rights granted to you under the laws of that country.
If you are a merchant, a legal entity under public law or a special fund under public law, or if you do not have a general place of jurisdiction in Germany, the place of jurisdiction shall be Munich, Germany, to the extent permitted by law.
If any provision of these Terms is or becomes invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
